Terms of Service
These terms are an agreement between you and Turtle Creek Enterprises, LLC ("we", "us") for your use of the Dinner Plans app and DinnerPlans.ai (the "Service"). By creating an account or using the Service, you agree to these terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility and accounts
You must be at least 13 years old to create an account, and if you are under the age of majority where you live, you need a parent or guardian's permission. You are responsible for your account, for keeping your sign-in details secure and for activity under your account. Tell us promptly at support@dinnerplans.ai if you believe your account has been compromised.
2. Households
You can invite others to share a household. Members can view and change shared pantry items, meal plans and lists, and can see other members' names and email addresses. Household owners and managers can invite and remove members. Only invite people you trust, and only add profiles for other people with their permission.
3. Food, allergy and health information
Always check ingredients yourself. Meal suggestions, recipes, nutrition estimates, product details, expiration estimates and allergen information in the Service may be incomplete or wrong, including content produced by AI and data from third-party product databases. Dinner Plans does not provide medical, nutritional or dietary advice and is not a substitute for a doctor or registered dietitian. If you or anyone you cook for has a food allergy, intolerance or medical condition, read product labels and verify every ingredient before preparing or serving food. Follow safe food handling and cooking practices. You are responsible for the food you prepare and serve.
4. AI features
Some features use artificial intelligence to scan photos, understand speech, suggest meals and write recipes. AI output can be inaccurate, so review results, such as scanned items and quantities, before relying on them. Do not submit photos or recordings of people who have not agreed to it, or content you do not have the right to share.
5. Subscriptions, tokens and payments
- Some features require a paid subscription or use tokens. Prices and what each plan includes are shown in the app before you buy.
- Auto-renewal: subscriptions purchased through the App Store renew automatically at the end of each period at the then-current price unless you turn off auto-renew at least 24 hours before the period ends. Your Apple account is charged within 24 hours before renewal. Manage or cancel in your device's Settings → [your name] → Subscriptions. Deleting the app does not cancel a subscription.
- Free trials: if a trial is offered, it converts to a paid subscription at the end of the trial unless you cancel before it ends. Any unused part of a trial is forfeited when you buy a subscription.
- Refunds: App Store purchases are handled by Apple under Apple's policies; request refunds through Apple. Web purchases are processed by Stripe; contact us about those.
- Tokens have no cash value, cannot be transferred and may expire as described in the app. We may automatically return tokens for requests that fail.
- We may change prices or plans. Changes apply to your next billing period, and we will give notice as required by the App Store or by law.
6. Your content
You own the content you add, such as pantry items, recipes, notes and photos. You give us a limited license to store, process, display and transmit that content only to operate and improve the Service for you and your household. You are responsible for your content and confirm you have the right to use it, including recipes you import from other websites.
7. Acceptable use
Do not misuse the Service. For example, do not: break the law or infringe others' rights; access other users' data; attempt to probe, scan or bypass security, rate limits or usage limits; reverse engineer the Service except where the law allows; use bots or scripts to access the Service or resell it; upload malware; or use the Service to harass anyone. We may suspend or terminate accounts that break these terms.
8. Third-party services
The Service links to or works with third-party services such as Instacart, Apple, Google and recipe websites. Those services are governed by their own terms and policies, and we are not responsible for them.
9. Changes and availability
We may add, change or remove features, and the Service may sometimes be unavailable. We may update these terms; if we make significant changes we will notify you in the app or by email. Continuing to use the Service after changes take effect means you accept them.
10. Ending your use
You can stop using the Service and delete your account at any time in the app. We may suspend or end your access if you break these terms or if we stop offering the Service. Sections that by their nature should survive termination will survive.
11. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or that its content, including food, nutrition and allergen information, is accurate or complete.
12. Limitation of liability
To the fullest extent allowed by law, Turtle Creek Enterprises, LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or US$50. Some places do not allow these limits, so they may not apply to you.
13. Indemnity
To the extent allowed by law, you agree to indemnify and hold harmless Turtle Creek Enterprises, LLC from claims arising from your content or your misuse of the Service or breach of these terms.
14. Governing law
These terms are governed by the laws of the State of Alabama, USA, without regard to conflict-of-law rules. Disputes will be brought in the state or federal courts located in Alabama, unless the law where you live gives you the right to bring them elsewhere.
15. Apple App Store terms
If you downloaded the app from the Apple App Store: these terms are between you and us, not Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support. If the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the app, including product liability, legal or regulatory claims, or intellectual property infringement claims. You confirm you are not located in a country subject to a US government embargo and are not on any US government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You must also comply with Apple's Usage Rules.
